PUBLIC CALL No. 04/24

FOR THE COLLECTION OF BIDS (TENDER) FOR THE LEASE OF REAL PROPERTY – LAND FOR THE INSTALLATION OF A TEMPORARY STRUCTURE FOR CONDUCTING COMMERCIAL ACTIVITIES – RETAIL OF RECREATIONAL AND CULTURAL ITEMS, REGISTERED IN THE LAND REGISTER NO. 974 KO PODGORICA I

 

The subject of this public call is the collection of bids for the lease of real property (land), part of cadastral plot number 1356/1, registered in the land register 974 KO Podgorica I, with an area of 8 m², for the purpose of installing a temporary kiosk-type structure to conduct commercial activities – retail of recreational and cultural items, located at Studentska Street, Podgorica, the Capital City of Podgorica.

 

The minimum (starting) annual rent is set at €480.00, excluding VAT.

 

The rent is payable in one installment, annually, within 7 days of signing the lease agreement.

 

The property in point 1 of this Public Call is offered for lease for a fixed term of five (5) years.

 

The property is to be leased for the purpose of setting up a temporary kiosk-type structure for conducting business activities in the retail sale of recreational and cultural items. The arrangement for the installation of the temporary structure will be defined in the Lease Agreement and the urban-technical conditions.

 

Interested bidders may visit the property during the period the Public Call is open, on working days (Monday to Friday), between 12:00 and 14:00, by contacting: 067411747.

 

The Public Call is open from the date of publication in the daily print media distributed throughout Montenegro and on the University of Montenegro website www.ucg.ac.me, until December 18, 2024, by 14:00.

 

Bids must be submitted in a sealed envelope, with the notation "For Public Call No. 04/24 – DO NOT OPEN BEFORE PUBLIC OPENING OF BIDS," to the address: University of Montenegro Rectorate, Podgorica, Cetinjska No. 2, Archive Office, on working days from 10:00 to 14:00, no later than December 18, 2024, by 14:00.

 

Participants in the Public Call must pay a deposit of 10% of the value of the bid for the property specified in point 1 of this Public Call to the University of Montenegros account at Crnogorska Komercijalna Banka A.D. Podgorica, account number 510-10115-56, with the reference “Participation in Public Call No. 04/24,” and submit proof of the deposit payment along with the bid in the sealed envelope. The bidder covers the deposit transfer costs.

 

If a bid is invalid or not accepted, the deposit will be returned to the bidder within seven days after the deadline for determining the ranking list. The deposit paid by the successful bidder will be credited toward the rent. If the successful bidder fails to sign the contract within the stipulated period or does not pay the rent by the agreed deadline, they lose the right to a refund of the deposit.

 

The public opening of the bids, which can be attended by the bidders, their representatives, or authorized persons, based on the provided power of attorney, will be held on December 18, 2024, at 15:30, at the University of Montenegro Rectorate, Podgorica, Cetinjska No. 2.

 

Submitted bids cannot be changed or supplemented.

 

Bids may be withdrawn up to three days before the deadline for submitting the bids by submitting a written statement or notice of withdrawal.

 

Eligible participants in the Public Call are legal entities registered for the activities for which the property is offered for lease.

 

Participants must submit:

 

- The name and address of the registered office of the company;

- A certificate of registration from the Central Register of Business Entities for domestic bidders or proof of registration from the relevant authority in the bidders country for foreign bidders;

- The legal entity’s VAT identification number (PIB);

- A certificate of VAT registration;

- Authorization for representation of the bidder;

- The offered rent amount in euros;

- Proof of deposit payment.

 

Documents must be submitted in original or notarized copies, no older than six months, and in the official language of Montenegro.

 

Bids received after the deadline, bids that do not specify the rent amount, bids with a rent amount lower than the starting bid, or bids from bidders who have not paid the deposit will be considered invalid.

 

The ranking and evaluation of bids will be based on the following criteria: the offered rent amount.

 

Criteria: Offered rent amount – 100 points

 

The committee will rank the bids deemed formally correct and financially and generally acceptable, and will establish a ranking list.

 

The highest offered rent will receive the maximum number of points, and the points for the other bids will be proportionally calculated based on the highest offered rent.

 

The committee must make a decision within five days of opening the bids.

 

Participants in the Public Call have the right to file a complaint to the committee within five days of receiving the results of the Public Call. The committee’s decision on the complaint is final.

 

A lease agreement will be signed with the successful bidder.

 

If the highest-ranked bidder refuses to sign the lease agreement within eight days of receiving the invitation to sign the contract, the University of Montenegro will retain the deposit and invite the second-ranked bidder to sign the contract.

 

The committee will declare the Public Call unsuccessful if the ranked bidders refuse to sign the lease agreement within the provided period. The Public Call will also be declared unsuccessful if no bidders apply.

 

The tenant does not have the right to sublet the leased land.

 

The tender rules are published on the University of Montenegro website along with the Public Call.

 

TENDER RULES

FOR THE PUBLIC CALL OF THE UNIVERSITY OF MONTENEGRO

04/2024

 

1. The tender for the lease of real property is organized and conducted by the tender committee, appointed by Decision No. 01-2046/6 dated December 10, 2024.

 

The tender committee can make decisions if more than half of its members are present.

 

The tender committee makes decisions by a majority vote of its members.

 

2. Eligible participants in the Public Call are legal entities registered for the activities for which the property is leased.

 

3. Ranking and evaluation of bids will be based on the criteria: offered rent amount.

 

The minimum (starting) annual rent is set at €480.00, excluding VAT.

 

Payment method for the rent: in one installment, annually, within seven days of signing the contract.

 

Bid evaluation is performed directly at the tender committee meeting, based on a point system defined by the tender rules.

 

Criteria: Offered rent amount – 100 points

 

The highest offered rent is awarded the maximum number of points, and the points for other bids are calculated proportionally to the highest offered rent.

 

4. The bid includes the rent amount for the tendered property.

 

Submitted bids cannot be changed or supplemented.

 

Bids may be withdrawn within three days before the tender deadline.

 

Bidders must pay a deposit for participation in the tender, equal to 10% of the offer value, and submit proof of deposit payment with their offer as a mandatory part of the offer.

 

5. The opening of the bids can be attended by the bidders, their representatives, or authorized persons with the provided power of attorney.

 

The tender committee will open the bids and verify their formal correctness.

 

6. Bids that are found to be untimely or not formally correct will be considered invalid.

 

7. The tender committee will rank the bids deemed formally correct, financially and overall acceptable, and establish a ranking list.

 

8. The deadline for the decision of the tender committee is five days from the opening of the bids.

 

9. Participants in the tender have the right to file a complaint to the committee within five days of receiving the results of the tender. The committee’s decision on the complaint is final.

 

10. The tender committee will declare the tender unsuccessful if the ranked bidders refuse to sign the lease agreement within the provided period.

 

The tender will also be declared unsuccessful if no bidders apply.

 

11. The lease agreement will be signed with the most favorable bidder. If the highest-ranked bidder refuses to sign the lease agreement, the second-ranked bidder will be invited to sign the agreement.
